Abstract

The present work approaches the voluntary jurisdiction in his historical significance from the codification, for on this base to justify the present of his juridical nature, foundation and character that is the base of the system on the one that one agrees. It must be born in mind by the legislator of the future Law of Voluntary Jurisdiction to support his positive aspects that I consider they are more of those who to the first sight seem, without prejudice of the necessary update of their particular acts. The work is divided into three parts. First: past and present of voluntary jurisdiction. Second, criticized the proposals that could be the future of this Act. Third. Like conclusions I defend my position with proposals.
