Abstract

The article focuses on the practice of informal agreement in Germany which has rapidly spread into all branches of criminal procedure. Topics discussed include the development of plea bargaining not only outside legislation but also against the explicit views of higher courts and the passing of the Bill for the Regulation of Agreements in Criminal Procedures by the German Federal Parliament which aims to legalize and regulate settlements without infringing the core principles of the procedure.
