- Abstract
The article discusses a court case of a person who was sentenced to 30 year's imprisonment on the ground of conspiracy. Some 10 years later, the "Court of Appeal" quashed his conviction on the ground that his deportation involved an abuse of process which rendered the conviction unsafe. He applied to the Home Secretary for compensation under the relevant ex gratia scheme, on the basis that his conviction had been reversed on the ground that there had been a miscarriage of justice. The "Home Secretary" refused the application both under section 133 and under the ex gratia scheme.
