- Abstract
This article, based on the premise of access to justice, aims to critically analyze Law No. 14.726/2023, which introduces a gratuity for cumulative office duties for members of the Union's Public Defender's Office (DPU). The goal is to investigate whether this law represents a genuine solution to the challenges faced by the DPU in promoting access to justice or whether, conversely, it merely diverts attention from more profound and structural issues. To this end, the present study employs a methodology that includes a review of specialized literature, analysis of legal documents, and evaluation of relevant data about the DPU. Furthermore, the article reveals that, despite Law No. 14.726/2023 genuinely recognizing the additional work of public defenders, it does not adequately address the broader challenges of the legal system in terms of access to justice. In this regard, the study concludes about the necessity of more comprehensive and effective approaches, thereby significantly contributing to the debate on more appropriate measures for promoting access to justice in Brazil.
