- Abstract
This article presents a discussion, based on bibliographical research, about the existence or not in our legal system of the right to good public administration, demonstrating its nuances, the implications of its recognition and its hermeneutic load as a resource for analysis of the Law of Biddings and Contracts. The work is divided into three parts: the first deals with the concept of good public administration, the second with the legal implications of recognizing the right to good administration in the Brazilian legal system and the third addresses the use of this right as a hermeneutic tool of the law of tenders and contracts. In conclusion, we arrive at an understanding of the recognition of good public administration as a fundamental right capable of being used as an interpretative tool for public procurement, aiming at the conformation of discretionary acts, which must be robustly motivated with the spirit of complying with the principles of administrative morality, transparency and efficiency.
