- Abstract
The article analyzes the balance and prospects of the Spanish Constitution of 1978, highlighting how power has moved away from the State towards higher and lower entities. It mentions the need to adapt constitutional institutions to non-state entities and eliminate the element of stateness when defining supranational bodies and internationally guaranteed rights. It also addresses the current challenges of the Spanish constitutional democracy, such as the economic and institutional crisis, political and social disaffection, and demands for emancipation that become polarizing drifts. The role of the Constitutional Court in shaping the autonomous state is criticized, and the importance of self-determination within the constitutional framework is emphasized. A call is made for a new consensus to guarantee the prosperity and stability of the country through constitutional reform.
