- Abstract
The article analyzes the legal nature of the CETA and the impact on constitutional powers in the free trade agreements between Canada and the European Union. It reflects on the incorporation of international law into Canadian domestic law, judicial control of legislative activity in international treaties, and Canada's legal negotiations with the European Union. The importance of the CETA as a reference in trade agreement policies is highlighted, as well as the limitation on legislative or regulatory capacity of European Union member states in negotiations with Canada. The article also addresses the legal nature of the CETA, Canada's legal negotiations with the European Union, and the legal conflicts that have arisen in Canada regarding the implementation of international treaties ratified by the Canadian government in the provinces. Additionally, the impact of the CETA on constitutional powers is mentioned, and the controversy surrounding the Joint Committee of the agreement is highlighted. The CETA has opened new opportunities for trade and investment between the European Union and Canada, benefiting both parties by eliminating or reducing customs tariffs and protecting investment and intellectual property rights. The agreement has had a positive impact on the economies of Canada and the European Union, increasing exports and creating jobs.
