- Abstract
Occupation is taking possession of a thing belonging to nobody (res nullius), but capable being owned. Occupation is originally title to ownership, because person entitled does not take from any predecessor. The things ownerless might be one which never belonging to somebody, or abandoned by previous owner. Things without an apparent owner in which no one claims a property, such as wild animal, fish, wild birds etc. belongs to somebody who has a permission by Law, to hunt it. Property that has been abandoned become res nullius, and a person taking possession of it therefore acquires a lawful titles. In Serbian Law occupation is possible only on movable and abandoned things, by occupant who is taking possession on it, in order to become owner. Immovables is not suit to acquired by occupation. If immovables become res nullius the ownership on it belongs to the State of Serbia.
