- Abstract
The article argues that preventing short sellers from participating in securities fraud class actions promotes the public interest goals of securities fraud lawsuits and the efficiency goals of the Private Securities Litigation Reform Act. Topics discussed include different types of investors in the securities markets, atypical investors acting as lead plaintiffs in securities fraud cases such as the Tesla litigation, and short sellers in various securities fraud contexts.
