- Abstract
The article discusses the confusion that is associated with the U.S. Supreme Court's ruling in the 2013 case Adoptive Couple v. Baby Girl which deals with the constitutionality of the nation's Indian Child Welfare Act (ICWA) and biological father Dusten Brown's efforts to intervene in an adoption proceeding involving his daughter who is a member of a Native American tribe. Statutory construction and Brown's failure to establish a custodial relationship with his daughter are examined.
