- Abstract
The article focuses on a 2006 New York state court decision and its implications for the legal liabilities of sports marketing promotions. In Curran v. CXR Holdings, a Long Island woman sued a local radio station for injuries she suffered in a scuffle over promotional T-shirts thrown into a crowd of beachgoers. The court's finding for the plaintiff is presented as upholding longtime legal precedent in tort law, notably the 1928 case Palsfrey v. Long Island Railroad. Marketers are cautioned on their responsibility in such promotions.
