- Abstract
The article examines the application of 18 U.S.C. Section 1346 statute by the federal government to prosecute public company executives for breaching their fiduciary duties in the U.S. It explores the controversial over the said statute, creating it as a felony to involve in a scheme to deprive another of the intangible right of honest services. Moreover, it mentions the certiorari granted by the Supreme Court in cases construing the honest services law.
