- Abstract
Objective: The objective of this article is to analyze the right to education as a way of recognizing human dignity and enforcing the fundamental and personality rights of those who are serving time in the Brazilian prison system. Method: The methodology used is deductive, dialogic and the method is hypothetical-deductive, starting from general concepts such as social rights and the principle of human dignity, to specific premises, such as public policy on education for only those serving sentences in the penitentiary system Brazilian. Results: The analysis showed that it is possible to re-socialize the inmates within the Brazilian penitentiary system through public policies in the area of education. Conclusions: The State, through public policies, has the duty to guarantee the education of inmates, as in addition to a constitutionally foreseen right, it is a rightmeans to implement others, thus promoting the dignification and re-socialization of the incarcerated person.
