- Abstract
The article discusses the decision of the Supreme Court of Pennsylvania in Pennsylvania Associated Builders and Contractors Inc. versus Commonwealth Department of General Services, which focused on the importance of allowing discretion in choosing a contractor who is best suited for the job, regardless of whether or not that contractor is the least expensive. The Separations Act and the Commonwealth Procurement Code are examined.
