- Abstract
The article explores a technical defense to construction claims that is failure to give notice. It explains the arguments for and against this defense, and discusses cases that deny claims for lack of notice as well as cases which refuse to allow lack of notice to prevent consideration of a claim on the merits. It is stated that it is important for contractors to understand the full literal requirements of their contractual provisions.
