- Abstract
The author reflects on the legal interpretation of the threshold of significant risk for HIV transmission, focusing on the ruling by the Supreme Court of Canada in R. v. Cuerrier in 1998, which held that a person living with HIV must disclose his/her status in situations when there is a significant risk of transmission. He mentions the R. v. Mabior and R. v. D.C. Cases on HIV-positive status nondisclosure. He adds that the Court issued updated ruling on HIV-status disclosure on October 5, 2012.
