- Abstract
The article offers insights on the subject of biotechnology patenting. Information on two high-profile legal decisions concerning biotechnology patenting is provided. It notes the important role of intellectual property (IP) in incentivizing investment in innovation. It points out that the U.S. Supreme Court's decision in the Mayo Collaborative Services v. Prometheus Laboratories Inc. case highlight the legal requirements for eligibility. It questions the fate of biomarker IP.
