- Abstract
The article attempts to reconcile the controversial decision of Roper v. Simmons with the Gang Deterrence and Community Protection Act of 2007 and the possibility of inconsistent jurisprudence. In doing so, it details the background of this Act, including the social conditions that gave rise to the need for such a proposal. It then identifies the Act's procedural posture in Congress as of early 2007 and describes the proposed amendments, expansions and implications concerning juvenile offenders. In addition, it discusses the development of the Act and explores its possible disparate application on juvenile gang members. Moreover, it explores capital punishment precedent as applied to juveniles. Other significant information and analyses relative to the matter are presented.
