- Abstract
The article defines concurrence and exclusivity, identifies seven modern instances of concurrence and explains its relation to the concepts of checks and balances, enumerated powers, and statutory interpretation in the U.S. It analyzes James Madison's argument for exclusivity that appears in Helvidius Number II and Alexander Hamilton's response in support of concurrence. Moreover, it identifies and analyzes recurring patterns that emerge across several doctrines in American constitutional law.
