- Abstract
This paper examines how a "new" constitutionalism has been developed, focusing more on fiscal control of the state than on the system of fundamental rights. The institutions of the "old" constitutional symbology have been replaced or supplemented by others that are more suited to this "new" constitutionalism, based on the search for economic efficiency as legitimation to the detriment of the democratic process as legitimacy. This constitutional "project of signification" is, in the end, a juridical-political surrender to economic logic, with the banner of triumph as the "austerity Constitution", with the centrality of rights moved to "fiscal" and "authoritarian" State, and demands of the financialized capitalism as determinant substrata.
