The article focuses on the history associated with requester-pays and other incentive system to supplemental judicial management of discovery and incentives as a complement to discretionary judicial decisions for controlling civil discovery. Topics discussed include U.S. Supreme Court decision in the case Oppenheimer Fund, Inc. v. Sanders on discovery request must pay the costs of complying, discretionary approaches to judicial management and draft of Federal Rules of Civil Procedure.
