- Abstract
The article explores comparative constitutional understandings for some of the difficult legal challenges of federalism. The comparative constitutional understandings about federalism can play an important role in adjudicating questions of structural relations. Federalism, as a set of approaches to shared governance over the same territory creates opportunities and challenges for international law. For transnational judicial discourse about rights, there is a relative dearth of comparative judicial exploration of issues of federalism.
