- Authors
Werner, Ray O.; Hartman, George E.
- Abstract
The article presents information on the marketing implications of procedural and legal developments. In regard to City of Lafayette, Louisiana and City of Plaquemine, Louisiana v. Louisiana Power & Light Co., the article discusses whether or not a city may sue and be sued under U.S. antitrust laws. The article explains that the U.S. Supreme Court has decided that yes, cities may sue and be sued, that cities may be treated as "persons" as defined by U.S. antitrust laws, and the doctrine of state immunity may be set aside in examining a city's competitive activity. The inapplicability of precedent in Parker v. Brown and the changing view of the Supreme Court as regards antitrust and civil rights liability of cities is presented.
