- Abstract
The article discusses the aspects of pay-if-paid clauses in construction sub-contracts. It discusses the aspects of enforcement of such clauses and provide an update about how different states in the U.S. are addressing the issue. It states that there is debate over whether general contractors should bear the risk of owner insolvency or whether freedom of contract mandates that such provisions be enforced as written.
