- Abstract
The article discusses access to justice in environmental cases which deal with private property and public laws in the U.S. as of March 2012, focusing on issues such as standing in court to enforce environmental laws, and preemption jurisprudence in hazardous substance and property damage tort cases. In the case Bates v. Dow Agrosciences LLC, the U.S. Supreme Court reportedly rejected a request for imposing common law liability on pesticide manufacturers.
