- Abstract
Retirement savings plan fiduciary litigation is everywhere—The plaintiffs' bar has identified this as a lucrative opportunity. When combined with compliance requirements, litigation has prompted some plan sponsors and fiduciaries to curtail their efforts at innovation. Similar to business decision making driven by rent-seeking or tax considerations (instead of economics), today’s plan sponsors may focus as much attention on litigation avoidance and compliance as on outcomes regarding retirement preparation. Ultimately, the participants pay—and suffer.
