- Abstract
There are some restrictions regarding foreign footballers in Turkish football teams. In fact, the number of footballers in foreign status who play in Turkish football teams is determined as 6+2 totaly 8 for 2009-2010 session by The Turkish Football Federation. Nevertheless, it appears as a problem whether or not this kind of a restriction could be a violation of the right of footballers who are European Union citizens. Literally, the harmonization of this restriction with "the prohibition on discrimination" regulated in Turkey-European Community Association Council Decision Nr. 1/80 seems to be not easy. There is no doubt that the footballers who are European citizens would benefit from the rights regulated in Decision because of their worker status; however the problem is whether or not these rights could be asserted by the persons concerned in Turkish law system. Because of that, the determination of the meaning of Association Council Decision Nr.1/80 is very important. In this context the other problem is whether or not The Turkish Football Federation which has a controversial legal status shall be bound to the liabilities arising from Association Council Decision Nr. 1/80. In conclusion, it is supposed that "6+2" rule infringes the rights of footballers who are the citizens of European Union States that are party to the Agreement and this circumstance causes the responsibility of The Turkish Football Federation.
