- Abstract
The article examines the position of the separation of powers doctrine within the Federal Constitution before and after the 1988 constitutional amendment to Article 121 in Malaysia. It evaluates the position of the doctrine in the judicial power of the Federation. It mentions that textual analysis and a review of the extant case law is made to determine which separation of power being incorporated within the constitution.
