- Abstract
The article looks at decision of the Rhode Island Supreme Court in the case Medical Malpractice Joint Underwriting Ass'n of Rhode Island v. Charlesgate Nursing Ctr. on tort law. It mentions that the Court determined that the claim of negligence alleged against Charlesgate Nursing Center did not constitute an intentional act. It also mentions that application of commercial general liability with the tortious actions of the insured amount to an intentional act.
