- Abstract
The article presents legal developments in marketing with particular focus on the regulation of channels of distribution. One of the developments describes the case of Ron Tonkin Gran Turismo Inc. v. Fiat Distributors Inc., et al. This case illustrates some of the circumstance in which a manufacturer may refuse a franchise to a new dealer, even if that dealer had been encouraged to apply for a franchise and had been denied because of the complaint of only one other franchisee, and if that franchisee and the manufacturer had acted jointly. Another development describes the case of SCM Corp. v. Xerox Corp., in which the court established some conditions under which a patent holder may refuse to license and market its patents, even when it is a monopolist.
