- Abstract
According to data from the STF-COVID-19 Action Panel (transparency), until the date of february 23, 2021, the Brazilian Supreme Court received 7,322 pandemic-related cases, with a total of 8,798 decisions on the subject. Thus, given the high judicialization of health in the COVID-19 pandemic, reflected in all segments of Justice, from the Supreme Court to the lower court, it is necessary to analyze the main decisions of the Excelso Court, in the light of art. 102, caput, of the Fundamental Statute, which establishes that it is primarily his responsibility to keep the Constitution, as well as of arts. 6º and 196 to 200, of the same Charter, which deal with the social and universal right to health.
