- Abstract
The article examines the effect of the case, Commission v Luxembourg, on the territorial application of British labour law. The author argues that the case highlights the tension between the labour law perspective traditionally adopted by national law and the Rome Convention on the one hand and the single market perspective adopted by the Court of Justice on the other. It considers the position under the Rome Convention/Regulation and the Posted Workers Directive (PWD) 96/74, as interpreted by the Court of Justice.
