- Abstract
The article contains an approach to insurance activity in Brazil and its regulation, which, as a rule, is rigorous and in constant flux between increasing requirements and reducing obligations, sometimes to stimulate the market, sometimes to keep the system safe and stable. Such a regulated business model is not exclusive to the country, but the rule in all countries that seek a developed market for both the insurer and the insured. At first analysis, the idea of regulation seems incompatible with economic liberalism or with a more potent capitalism, seeming like the idea of statist, socialist thinkers, defenders of an intervening state. We studied why such thinking is not in accordance with factual reality, analyzing this (security) market, verifying the connection between regulation and liberalism, between intervention, supervision and strengthening of capitalism, when the subject is the insurance market. It was verified whether the current regulation is sufficient and whether it has the necessary tools to maintain the health of the national security system, especially in light of current technological changes. The deductive method was used, starting from the established norm, with analysis of its location in the legal system and verification of its appropriate use or not. A line of qualitative theoretical research was adopted, with analysis of bibliographic sources, laws and infra-legal norms. It was concluded that regulation, including self-regulation, and effective supervision, are essential to the development of society, and are not contrary, but beneficial to the current stage of the capitalist system.
