- Abstract
The article examines the issue of education deprivation as a form of violation of procedural due process. Since a student has rights under the Fourteenth Amendment of the U.S. constitution, it is assumed that deprivation of education violates due process if the student is totally deprived of an education without a hearing. The author argued that removing a student from the classroom for prolonged periods of time is a form of deprivation of an education. A "Couture" report about a teacher's use of timeouts under the Behavioral Intervention Plan of the Individual Education Plan.
