- Abstract
In this article an analysis of the legal nature of the public policy of entry into public employment is carried out through a brief normative genesis of the subject and in this way understand if we have had normative progress or it is possible to show setbacks in the execution of the norms of admission to the administrative career, identifying the vicissitudes, the obstacles that we find from our perspective in the implementation of this regulation for its execution from the perspective of a state entity and how it has affected the implementation of merit in Colombia, the above having taking into account that special importance arises because the human resource is the main support for the development of the state purposes defined in our Political Constitution. Establishing if Colombia is a State that has sought to strengthen public employment or if, on the contrary, there is an intention to maintain the usual patronage and political loot, finding that initially we have a system for entering the administrative career with normative robustness and that through the imposition of the empire of the judges since its pronouncement that admission to the administrative career must be through merit for the cases that are contemplated and not automatic. Finding that Colombia has sought a normative strengthening and has achieved it, materializing mainly since the 1991 constitution and although the constituent understood the importance of this issue, the subsequent legislatures that have had to regulate it for a better implementation, in our opinion, have not had the true intention to do it, therefore today we have a system that does not have enough budget or personnel to be able to execute it.
