The article presents the text of a speech by Carlos R. Moreno, associate justice at the California Supreme Court, about the impact of the initiative process on the criminal justice system and the work of the courts, delivered during the annual appellate defenders dinner on April 9, 2010. Topics discussed include the role of prosecutor or defense attorneys to assert and defend the rights of people, some flaws in California's initiative process and the lax enforcement of the single subject rule.
