- Abstract
The article reports on the issues that need to be considered concerning famous and scandalous trademarks while considering the U.S. federal trademark registration law and protection benefits. It was inferred that scandalous and immoral trademarks are subject to registration prohibition and will not avail the common law protection as stated in the trademark registration act. It was believed that famous marks have the advantages of obtaining trademark registration from the government. It states that the development of standards and evaluating scandalous marks can help trademark applicants achieve federal registration and protection under the trademark law. In addition, better understanding on scandalous marks should be considered.
