- Abstract
The article presents legal developments in marketing relating to the regulation of price competition. Regarding price discrimination, the case of F. Joseph Callahan v. Scott Paper Co. is discussed, involving a discharged employee that allegedly exposed, objected to and made efforts to eliminate unlawful discriminatory pricing practices in the company. Regarding price control, the case of D & S Redi-Mix v. Sierra Redi-Mix and Contracting Co., Eddie Cyr, d/b/a Cashway Concrete and Materials is discussed, involving producers who join to create a price cutting competitor in order to drive another competitor out of business, which was ruled as predatory pricing. The case of Gerald S. Maykuth, d/b/a Brighton Beverage v. Adolph Coors Co. is also discussed.
