- Abstract
The objective of the present investigation is to identify the state gaps, derived from the absence of sufficient mechanisms for an effective reparation, specifically of Afro-descendant inhabitants of the municipality of Riosucio (Chocó), who have been victims of the armed conflict. The methodology applied corresponds to the documentary and jurisprudential analysis of judgments of the Inter-American Court of Human Rights and the Constitutional Court, state reports, testimonial testimonies and secondary sources; through them, a case study of the community of the Cacarica river basin, in Riosucio (Chocó), is conducted. The analysis of the study documents, testimonies and the jurisprudence proffered in this regard at national and international level allows to establish if the State, as the main protector of fundamental rights, has failed to comply with the legal commitments acquired regarding the reparation to the displaced community of the Cacarica river basin, where military operations against the civilian population took place, one of them called 'Operation Genesis'. Everything allows to conclude that the State does not fulfill the commitments related to the reparation of victims and lacks internal instruments to guarantee a satisfactory and total reparation of those affected.
