- Title
State Court Intervention in International Arbitration: The United States Perspective*.
- Authors
Lamm, Carolyn B.; Hellbeck, Eckhard R.
- Abstract
The article focuses on the extent to which the U.S. State Courts can intervene in international arbitration. In the U.S., the state court intervention in international arbitration is governed by the U.S. Federal Arbitration Act which permits the U.S. courts to intervene only in limited circumstances. Under this act, the U.S. courts are allowed to compel arbitration, to appoint arbitrators, and to compel witnesses to attend an arbitration hearing, or to sanction a witness for failing to appear.
