- Abstract
The article explains the rejection of the point of novelty test and the ordinary observer test modification in the case Egyptian Goddess Inc., v. Swisa Inc. in the U.S. It discusses the design patent law prior to the case, focusing on the development of the two-prong test of design patent infringement. It explains the facts and analysis of the case and its effects on design patent infringement law.
