- Abstract
The author comments on the two seminal cases in Israel and the U.S. which regards on the conflicting views of the courts on the application and rights-balancing of contract law to resolve frozen embryo disposition disputes. The cases that were mentioned were Nahmani v. Nahmani and Davis v. Davis. The author argues that vagueness and jurisprudence in Israel and the U.S. on international reproductive rights protection could provide a foundation for embryo disposition's international consensus.
