- Abstract
The article reports on determining an insurer's potential bad faith exposure for adverse trial outcomes, set-dement conduct, and/or coverage disclaimers in the U.S. It is said that in order to assess the exposure, practitioners and claims professionals need to know the evolving bad faith litigation landscape, different viable bad faith claims' viable bad faith claims and effective legal defenses. Courts invoked the implied covenant of good faith and fair dealing inherent in all contracts.
