"Lawful Requirement" Provision of the Ohio Constitution.
- Abstract
The article focuses on some provisions of the Constitution of Ohio regarding the effect of occupational safety legislation. In the Constitution, there was reserved the right of action for damages where injury or death resulted from the failure of the employer to comply with any lawful requirement for the protection of the lives, health, and safety of employees. In the supreme court cases of American Woodenware Manufacturing Co. versus Schorling, Patten versus Aluminum Castings Co. and Toledo Cooker Co. versus Sniegowski, suits for damages were refused on the ground that the statutes on which the action was based did not establish specific lawful requirements within the meaning of the constitution
