- Abstract
The article offers an overview of the debate and passage of the Opportunity Scholarships Act in the Nebraska Legislature and the subsequent fight to put the issue on the ballot in 2024. Cited are the language of article VII, section 11 of the Nebraska Constitution which prohibits appropriations to nonpublic schools, the inapplicability of the state action doctrine to private schools receiving public funds, and the state's three tax credit programs that share some similarities with the Act.
