- Abstract
The article focuses on the decision of the Supreme Court of Missouri in the case State v. Perry on review of the application of an incorrect sentencing range. It considers the limited ability of defendants to obtain relief, both on direct appeal and in seeking postconviction relief, when the incorrect sentencing range is used but the error is not preserved for appellate review. It also mentions Court have created a rebuttable presumption of prejudice.
