- Abstract
The article discusses the use of public choice theory in the construction of constitutions. Topics mentioned include the similarities and differences in approach to constitutions between economists Anthony de Jasay and James M. Buchanan and philosopher John Rawls, symmetry between the U.S. and Portuguese constitutions, the role of identity uncertainty in the standard public choice approach to constitutional political economy, and Jasay's criticism of the sanctity of constitutional rules.
