- Abstract
The article provided a summary on the controversial cases concerning evidence decided by the U.S. Court of Appeals in 2010. It examines the evidentiary trends in the Eleventh Circuit depicted in the cases Daubert v. Merrell Dow Pharmaceuticals Inc., United States v. Ellisor, and United States v. Lewis. The author comments that the court relied heavily on unpublished decisions to resolve these cases without the creation of binding precedent.
