- Abstract
The article discusses the legal aspects of a pre-accusation delay in America as of April 2013, focusing on the Speedy Trial Clause of the U.S. Constitution's (USC's) Sixth Amendment, statutes of limitation, and the ripeness legal principle. The U.S. Supreme Court (USSC) is addressed, along with the Due Process Clause in the Fifth Amendment to the USC, and the USSC cases United States v. Marion and United States v. Lovasco. A delay-related strict two-prong court test is also examined.
