- Abstract
The article discusses the issue of vulnerable adults with capacity falling through the cracks of the Mental Capacity Act (MCA) 2005 in England and Wales. While the MCA provides procedures for decision-making authority for adults lacking capacity, it does not cover capacitous vulnerable adults. As a result, the High Court continues to intervene in the lives of these adults who are deemed at risk. The article argues that vulnerability and autonomy are not incompatible, and healthcare practitioners and the courts should promote the autonomy of capacitous vulnerable adults.
